Terms of Service

1. Acceptance of Terms

By creating an account or using BloodSight, you agree to these Terms of Service ("Terms"). If you disagree with any part of these Terms, do not use the Service.

2. Service Description

BloodSight is a web-based tool that allows users to upload blood test results, receive AI-powered analysis, and track biomarker trends over time. The Service is designed for informational and educational purposes only.

3. Medical Disclaimer

Please read this section carefully. By using the Service, you acknowledge and agree to the following:

  • The Service does NOT provide medical advice, diagnosis, or treatment.
  • Use of the Service does NOT create a doctor-patient relationship.
  • AI-generated analysis may contain errors and is not reviewed by licensed medical professionals.
  • Always consult a qualified healthcare provider before making any health decisions.
  • The Service is NOT a substitute for professional medical evaluation.

4. Eligibility

You must be at least 18 years of age to use the Service. You may not create profiles for individuals under 18. By using the Service, you represent and warrant that you are at least 18 years old.

5. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access to or use of your account. We reserve the right to suspend or terminate accounts involved in unauthorized activity.

6. Subscription and Billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Subscriptions automatically renew at the end of each billing cycle until canceled. You can cancel your subscription at any time from your account settings; your access will continue until the end of the current billing period.

Prices may change with prior notice. Continued use of the Service after a price change constitutes your acceptance of the new pricing.

7. Refund Policy

  • If you are not satisfied with the Service, you may request a full refund within 14 days of your initial purchase.
  • Refund requests submitted after 14 days may not be eligible for a refund.
  • To request a refund, contact support@bloodsight.com with your account email and purchase details.
  • All purchases are processed by Paddle. Approved refunds are typically processed within 5-10 business days.

8. User Content and Data

You retain ownership of all data you upload to the Service. You grant us a limited, non-exclusive license to process your data solely for the purpose of providing the Service. When you delete an analysis or your account, all associated data -- including uploaded files, results, and AI interpretations -- is permanently deleted.

9. AI-Generated Content

Analysis outputs are generated by third-party AI service providers. These outputs may contain inaccuracies and are not reviewed by medical professionals. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.

10. Acceptable Use

You agree not to:

  • Use the Service for clinical decision-making without consulting a healthcare professional.
  • Upload false or misleading data.
  • Attempt to reverse engineer, decompile, or exploit the Service.
  • Resell, sublicense, or commercially redistribute the Service.
  • Use automated tools to scrape or bulk-access the Service.

11. Intellectual Property

We own all rights to the Service, including its design, code, and AI analysis pipeline. You retain ownership of your uploaded data and personal information.

12. Third-Party Services

The Service relies on third-party providers including AI service providers (analysis), Paddle (payment processing), and Google (authentication). Your use of these services is subject to their respective terms and privacy policies.

13. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY OF AI-GENERATED CONTENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL FEES YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

17. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately and your data will be permanently deleted.
